Commercial Property Rental Legislation Reform
1 000 000 commercial premises are rented.
The contract to rent is known as a lease.
80% of these leases are managed by a property portfolio management company or private equity fund company.
These giant corporate organisations have a monopoly over the estates they manage and between them they have a cartel type stranglehold on the entire market.
Tenants are 99% small family businesses that do not have professional advice when signing a lease.
These monopoly property landlords have the power to influence our government and our legislation.
The very legislation is what our small businesses depend on for their protection:
The Landlord and Tenants Act 1954 part 2
If you want to start a business and rent a property you will find that every one of these monopoly landlords force you to "contract out of the act" removing your rights from day one.
The property industry attempts to self regulate under the trade body called The Royal Institution of Chartered Surveyors (RICS) in particular they have a code of conduct called:
RICS Standard for Leasing Business Premises 2020
This does not stop these landlords removing your rights!
This advises good practice but does not enforce it.
When it comes to rent increases you will be shocked to find out that this trade body has decided that their RICS Standard for Leasing Business Premises 2020 does not apply to the rent increase process!!!

RICS:

Change existing RICS best practice guidelines into mandatory requirements.

Expand the scope of protection of the "RICS Standard for Leasing Business Premises 2020" to include Rent Reviews.

Change the hierarchy of evidence in arbitration at rent review to give highest priority to the current going rate to establish a current market value. (The average of what is currently being paid).

Reduce these valuations by the vacancy rate less 10%.
Landlords and Tenants Act 1954 Part 2:

Change to an opt in system for occupancy longer than three years.

Allow no more than 20% of monopoly portfolios to be refused protection.

Allow for easy refusal for small portfolio landlords.

Allow for faster forfeiture systems for breaches.
